This website (www.beingwear.com) is run by Being Wear Pty Ltd (ABN 21 684 512 641), and by visiting or shopping with us, you’re agreeing to a few simple terms (which we’ll just call Terms).

By browsing, clicking or shopping on our site, you’re saying you’ve read and understood these Terms and you’re good with them. If you’re not, that’s okay too, but you’ll need to step away from the site for now (we’ll still be here if you change your mind).

If you’re not legally able to enter into a contract, or if you’ve been temporarily or permanently restricted from using our site, you’ll need to sit this one out.

Anything we haven’t specifically given you permission to do under these Terms stays with Being Wear - all rights reserved.

Access & using your account

Some parts of our website are open for everyone to browse (check out all the feel good Being Wear items). But if you want to shop or unlock all the good stuff, you’ll need to create an account.

To set up your account (or place an order), we’ll ask for a few personal details, like your name, delivery address and payment info. We look after all your info in line with our Privacy Policy (you can read that here).

When you create an account or make a purchase, it’s super important that all your details are accurate and up to date. You’re responsible for keeping your password safe (maybe don’t write it on a sticky note next to your computer) and for anything that happens under your account.

If you think someone else has gotten into your account, let us know right away at beinghelpful@beingwear.com. We’ll help you sort it out.

When you place an order, it’s covered by our Terms & Conditions of Sale, which you’ll see before you check out.

Sometimes (rarely, but it happens), we might need to limit or block access to the site, whether it’s for security, maintenance, or just to keep everything running smoothly. If we think your account’s been compromised, we might temporarily suspend it to keep things safe.

Creativity & ownership

Everything you see on our site, from the product designs to the photos, videos, text, and graphics (we call this the Website Content), belongs to Being Wear or the talented creatives we work with.

That means you’re welcome to browse, enjoy, and be inspired, but you can’t copy, sell, tweak, or share anything without our written permission. That includes making new things based on our stuff.

We love sharing creativity, but we also believe in respecting the work that’s gone into creating it. Thanks for understanding.

Changes to these terms

Just like fashion, these Terms might change from time to time. When they do, we’ll pop the updated version right here. Keep checking back if you want to stay in the loop.

Sometimes, we’ll link you to other websites we think you might find interesting, helpful, or just cool, we call these external websites. These are run by other people, not us, so we can’t promise they’ll stay up-to-date or work perfectly.

Unless we say otherwise, linking to an external website doesn’t mean Being Wear is giving it a big thumbs up, endorsing it, or recommending everything you find there, it’s just there if you want to check it out.

If you decide to click through, you’re doing so at your own risk, Being Wear isn’t responsible for anything that happens once you leave our site. That includes if you rely on something you see there, or if the products or services they offer don’t meet your expectations.

Oh, and while we do our best to keep our site safe, we can’t guarantee that files you download (from us or anyone else) will be totally free from sneaky viruses or bugs. Stay safe out there.

Keeping things accurate

Everything on our website, from product info to delivery timelines, is shared in good faith and we do our best to keep it up-to-date and accurate. But, we can’t guarantee it’ll always be 100% perfect.

If something’s wrong or incomplete, we’ll fix it as soon as we can, but to the maximum extent the law allows, Being Wear isn’t responsible for any issues or losses that might pop up from relying on outdated or incorrect info on our site (or on any external site we link to).

Playing fair

We’re all about good vibes here, so, when you visit Being Wear, you agree to play fair and not do anything dodgy, like:

  • Breaking any laws or our policies
  • Hiding or faking your identity or location
  • Messing with our site’s systems or trying to hack anything
  • Posting anything that’s false, misleading, offensive or just plain nasty
  • Using bots, scrapers or any sneaky tech to mess with the site
  • Helping anyone else do any of the above

If we catch you doing any of this, we can (and will) block your access to Being Wear straight away. And if we need to take legal action to protect ourselves, we absolutely will.

Privacy & data

When you shop with us, you’re trusting us with your personal info and we take that seriously. Our Privacy Policy covers exactly how we collect, store, and use your data (you can read it here).

Unless your info is covered by our Privacy Policy, anything you send to us (like feedback, ideas, or questions) can be used by us however we like, though we’ll always respect your moral rights (because that’s just good manners).

Like most websites, we use cookies to help improve your experience. Cookies help us remember you and show you the stuff you actually care about. You can disable cookies in your browser if you prefer, but it might make the site a little less magical.

And, just so you know, if you break the law or breach these Terms, we might need to share your details with the relevant authorities (hopefully it never comes to that).

No promises, just our best effort

We work hard to keep Being Wear running smoothly, but we can’t guarantee the website will always be available or totally glitch-free (sometimes tech just does its own thing). If the site’s down or acting up, we’ll fix it as fast as we can.

To the extent the law allows, we’re not responsible for any direct, indirect, or unexpected losses that might happen because of issues with our site, including things like lost data, broken orders, or service interruptions. That’s just the reality of the internet.

Security & safety

The internet can be a wild place and when you access Being Wear, you’re using networks and services we can’t fully control (like your internet provider).

That means you take on some of the risk when using our site, especially if your connection isn’t secure. Be smart, use strong passwords, and stay safe out there.

 When we have to say goodbye

If you break these Terms (or do something dodgy), we can suspend or close your account at any time - no warnings needed.

 We don’t want to do that, but we’ve got to look after our community and our business. If we do have to take action, we’ll do what’s necessary to protect Being Wear and everyone who loves it.

You’ve got our back, we’ve got yours

If something you do causes Being Wear any legal trouble, for example, if you break these Terms or infringe on someone else’s rights, you agree to cover any costs, damages, or expenses we face because of it (including legal fees).

This applies even after you stop using the site. It’s a commitment that sticks around.

Keeping things flexible

Sometimes, we need to update these Terms (just like we update our products). When that happens, we’ll post the changes here and by keeping on using Being Wear, you’re agreeing to the new Terms. If you don’t like the changes, no hard feelings, but you’ll need to stop using the site.

If something doesn’t add up

If any part of these Terms turns out to be illegal or unenforceable, the rest still stands. We’ll tweak the wonky part to make it legal if we can, and if we can’t, we’ll just leave it out (without affecting the rest).

No takebacks

If we don’t immediately act when you break these Terms, that doesn’t mean we’re giving up any of our rights. We’re just choosing when to enforce them.

The legal bit

These Terms (and everything to do with Being Wear) are governed by the laws of New South Wales, Australia. If we ever need to take things to court, it’ll happen in New South Wales and you agree to that.

If you’re visiting from outside Australia, it’s up to you to make sure you’re following local laws when using our site.
